I don’t know state-wise, but I think it’s illegal in Chicago now.

I think it’s only illegal if you have the actual cell phone to your head, not if it’s a headset or you have some other special thing for it.

The city of Chicago has a law that you must use hand-free devices to talk on the cell phone.

It’s not a state law here in Michigan, but the City of Detroit has an ordinance, they can’t pull you over for it, but if they pull you over for someting else, they can tack on a $100 fine if they beleive the infraction was caused as a result of you talking on a cell phone.

ALL states want to make the activity illegal because you can’t talk on the phone and drive defensively at the same time. It has been proven time and time again. You are not the exception to the rule. You will be the cause of an accident and then you will never need your phone again.

It’s not illegal in any state to talk on the cell phone, it’s illegal to talk on a HAND HELD cell phone – in those states you are required to use an earpiece/headset, or speakerphone.

If you don’t already have one, get an earpiece for a few bucks and use it while driving, because whether it’s legal or not, hand held phones while driving are proven to be dangerous, so just do the smart thing no matter what state you’re in.
